...boas férias, Constança... (...e se tiveres o quintal a arder, vai comprar um balde...)

(...não sendo eu particular adepto - aliás, bem longe disso - do tipo de jornalismo feito por esta "news magazine", terei que concordar que a elaboração da capa desta edição está perfeita...)

Um acórdão do Tribunal da Relação do Porto redigido pelo juiz desembargador Neto de Moura, e assinado também por Maria Luísa Arantes, justifica a manutenção da pena suspensa para um homem que agrediu violentamente a mulher com uma moca com pregos. Para explicar que “o adultério da mulher é um gravíssimo atentado à honra e dignidade do homem”, os magistrados argumentam que há sociedades “em que a mulher adúltera é alvo de lapidação até à morte”; que “na Bíblia podemos ler que a mulher adúltera deve ser punida com a morte”; e ainda que o Código Penal de 1886 “punia com uma pena pouco mais do que simbólica o homem que, achando sua mulher em adultério, nesse acto a matasse”.

Segundo o acórdão, “o adultério da mulher é uma conduta que a sociedade sempre condenou (são as mulheres honestas as primeiras a estigmatizar as adúlteras), e por isso [a sociedade] vê com alguma compreensão a violência exercida pelo homem traído, vexado e humilhado pela mulher”.
A mulher, de Felgueiras, foi agredida em 2015, e a agressão não foi só protagonizada pelo então marido, mas também pelo ex-amante.

1ª nota --- infelizmente, esta noticia acaba por encaixar no post aqui colocado no transacto dia 15-10-2017 - https://lonewolfpt.blogspot.pt/2017/10/provavelmente-piada-mais-triste-do-ano.html .

2ª nota --- o relator desta tristeza é um "homem"(!?!?!), mas o mesmo acórdão é igualmente assinado por uma mulher. Das duas, uma: ou a sra. Desembargadora assinou o mesmo de cruz e sem o ler sequer; ou concorda na totalidade com tudo o que é ali sentenciado. Das duas hipóteses, não consigo ainda atingir qual será a mais grave e lamentável.

3ª nota --- quer na Magistratura Judicial, quer no Mº Pº; quer nas primeiras instâncias, quer nas instâncias superiores; quer nas anteriores gerações, quer nas mais recentes, é recorrente ver, infelizmente, "terrores" similares ao que foi agora proferido, por mulheres e de homens que têm o poder e, mais ainda, a responsabilidade de decidir sobra a vida das pessoas. E é arrepiante ver serem tomadas decisões que se desviam por completo da real aplicação da legislação penal e mesmo da Constituição da República Portuguesa e, mais grave e inclusivé, da lei do elementar bom-senso. Assim, talvez não fosse má ideia dos responsáveis que formam os juízes e os magistrados do Ministério Público no Centro de Estudos Judiciários, efectuar uma triagem no acesso aos cursos que implicasse uma rigoroso, atenta e competente avaliação psicológica dos candidatos (e não se focassem única e exclusivamente na avaliação técnica e curricular) e avaliar da maturidade intelectual e cívica das pessoas que vão lançar depois nas diversas comarcas de Portugal para aplicar a justiça...
